There is Not Any Such Occurrence as a Drunk Driving Jinx
<< Household Topics Buy A Heater And Leave Your Bed Warm >>An interesting phenomenon occurred to me last night that I continue to observe happening over and over again. I was at my house and my brother-in-law dropped by to talk. We are all sitting about shooting the breeze and someone made a wise crack regarding my being a criminal lawyer. That is nothing novel, but it reminded me that I'd recently had several new driving under the influence and traffic specific industry cards made up, so I went and grabbed them and tried to distribute them out.
The cards are excellent, by the way. On the front is my name and data, like a traditional industry card would be, but on the rear is some outrageously high-quality data that everybody ought to hold (and I advise everybody to hold this card in their automobile, just in case they are pulled over for something). It gives you five things to do if you are stopped by the police (now, bear in mind that I am a Seattle driving under the influence defense attorney, so these regulations may not automatically apply in your state):
1. Present the police officer your license and registration and be hushed - utter "my lawyer told me not to reply to that question."
2. Don't fall for the officer's actions - remain silent and respectful.
3. Don't do field sobriety tests or a portable breath test - ever.
4. If detained speak these words - "I would like to remain mute and talk with my attorney" - and not anything else.
5. Never agree to a search of anything - just declare no.
As I was attempting to dispense this beneficial data to my brother-in-law, he said, with a straight face "I don't want that. It's going to plague me into getting into trouble." I would have been shocked if I hadn't heard it previously, but it got me to thinking that possibly I ought to try to point out why he should want it.
First, there is no such event as a curse. There is only dreadful fortune. In spite of what one may reason, you getting pulled over and investigated for Seattle driving under the influence is and will never be in any way associated to you accepting my industry card.
Second, by declining this card, you are throwing away useful information that could considerably lower the chance of a DUI guilty verdict if you are ever investigated and detained for DUI. Why put your skull in the sand and walk into a circumstance unprepared when the information is directly in front of you?
Third, if you really don't want to curse yourself, don't drive drunk and you won't have to be anxious regarding it. Not that my brother-in-law does (I spot individuals in my office day after day who were most likely not too drunk to drive when seized for DUI - only the laws make it almost impossible to contend that). keep in mind that it is not unlawful to drink and drive, it is only unlawful to drive drunk.
If you are reading this and you have a criminal defense attorney pal that attempts to present you his card because there is magnificent information on it - seize it. Put it in your car. Read it and ask your buddy inquiries. When you are pulled over by the police (and chances are it will happen some day) you can be ready to fight for your rights.
